Terms of Service
The agreement between you and Keytween: accounts, credits, payments, refunds, your content and our responsibilities.
Last updated
These terms are an agreement between you and Keytween ("we", "us") and cover your use of the Keytween website, app and API (the "service"). By creating an account, buying credits or using the service you accept these terms and the Acceptable Use Policy, which is part of them. If you do not accept them, do not use Keytween.
Eligibility and accounts
- You must be at least 18 years old and able to enter a binding contract.
- Your account is personal. Keep your password, recovery code and API keys secret. You are responsible for everything done with your account and keys.
- We do not collect an email address, so we cannot reset your password for you. If you lose both your password and your recovery code, we may not be able to restore access, and credits in that account may be lost.
- One person may receive free trial credits once. Trial credits have no cash value and we may change or end the trial at any time.
Credits and prices
- Generations are paid for with prepaid credits. The credit cost of each generation is shown before you start it and on the pricing page.
- Credits are a licence to use the service. They are not money, have no cash value, do not earn interest and cannot be transferred, sold or exchanged.
- Credits do not expire while your account is open.
- We may change credit prices and generation costs. Changes do not affect credits you have already bought, but future generations use the cost shown at the time you start them.
- Prices are in US dollars. Card payments are processed by Stripe, and your card details never reach us. Paying with Monero costs less for the same credits.
- You are responsible for any taxes, bank or currency charges that apply to your purchase, unless we collect them at checkout.
Refund policy
All credit purchases are final. Please read this before you buy:
- Credits are non-refundable and cannot be exchanged for cash, in whole or in part, once they have been added to your account, whether or not they have been used.
- If a generation fails or you cancel it before it finishes, its credits are returned to your account automatically. These refunds are made in credits, not money.
- Generated results depend on your prompts and images and vary from run to run. Being unhappy with a result that did complete is not a reason for a refund.
- If you were charged twice or charged without receiving the credits, email [email protected] and we will put it right. We may also refund at our discretion, and we will always give refunds that the law where you live requires.
- Credits in an account that is closed for breaking these terms or the Acceptable Use Policy are forfeited and are not refunded.
Chargebacks and payment disputes
If something is wrong with a payment, contact us at [email protected] first; most problems are fixed within a day. If you dispute a payment with your bank or card issuer instead, we will remove the credits from that purchase and close the account while the dispute is open. We may refuse future purchases from anyone who disputes a valid charge.
Your content
- You keep whatever rights you have in the prompts and images you upload. Only upload material you own or have permission to use.
- As between you and us, you own the images, video and audio you generate, to the extent the law allows. Some countries do not grant copyright in AI-generated material, and similar results may be generated for other users, so we cannot promise that your results are unique or protectable.
- You give us the permission we need to store, process and show your content to you in order to run the service. We do not sell your content, publish it, or use it to train models.
- When you delete a sequence or a generation, we delete its files and prompts. Deleted content cannot be recovered.
- You are responsible for your content and for how you use it, including following the Acceptable Use Policy and the rules of any platform where you share it.
Using the service
- We work to keep Keytween available and fast, but the service is provided as it is and as available. Generation times vary, and the service may be slowed, paused or changed for maintenance, load or other reasons.
- We may add, change or remove features at any time.
- The API may only be used as documented, and its rate limits apply.
Suspension and closing accounts
- You may stop using the service or delete your account at any time. Credits left in a deleted account are forfeited and are not refunded.
- We may suspend or close your account, without notice, if you break these terms or the Acceptable Use Policy, if your use puts the service, other users or us at risk, or if the law requires it.
- If we close an account for any other reason, we will refund the unused credits you paid for, in proportion to what you paid.
Disclaimers
AI-generated output can be inaccurate, unexpected or unsuitable, and may resemble existing works or people. You use it at your own risk. To the extent the law allows, we make no warranties about the service or its output, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim about the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
Indemnity
You agree to defend and compensate us for claims, losses and costs, including reasonable legal fees, that arise from your content, your use of the service or your breach of these terms or the Acceptable Use Policy.
Governing law
These terms are governed by the laws of the State of Washington, USA, without regard to its conflict of laws rules. Any dispute about the service or these terms will be heard in the state or federal courts located in Washington, and you and we agree to their jurisdiction. If you are a consumer, this does not take away protections that the law where you live gives you.
Changes to these terms
We may update these terms. The date at the top shows when they last changed. If you keep using the service after a change, you accept the updated terms. Purchases are governed by the terms in force when you made them.
